These Terms of Service (“Terms”) govern your access to and use of Boongle IDE, the Boongle website, related downloads, and any associated services (collectively, the “Service”) operated by the Boongle development team (“Boongle”, “we”, “us”, or “our”). By creating an account, downloading the app, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Boongle IDE is a desktop code editor with AI-assisted features, including chat agents, inline edits, tab completions, terminal tools, plugins, and optional cloud-connected features such as account sync, usage metering, and BoongleBase databases on eligible plans. Features may change, be added, or be removed as the product evolves.

The Service is provided on an early-access basis. We do not guarantee uninterrupted availability, error-free operation, or that any particular feature will remain available in future releases.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. You may use the Service only if you can form a binding contract and are not barred from doing so under applicable law.

3. Accounts and security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate account information and keep it up to date.
• You must notify us promptly if you suspect unauthorized access to your account.

We may suspend or terminate accounts that violate these Terms, pose a security risk, or are used for fraud or abuse.

4. Plans, billing, and usage

Boongle offers free and paid plans with different usage limits and feature access. Plan details, pricing, and included usage are described on our website and in the app and may change over time.

• Paid plans, checkout, and billing features may roll out gradually and may require manual review during early access.
• Usage limits, model access, and included API credit apply per plan and billing period as shown in the app.
• Promotional access, beta invites, referral rewards, and partner offers are subject to the terms shown at the time they are granted.
• Unless required by law, fees already paid are non-refundable except where we explicitly state otherwise.

5. Acceptable use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Generate, store, or distribute malware, spam, or content that is illegal, harmful, or abusive.
• Attempt to gain unauthorized access to systems, accounts, or data.
• Reverse engineer, scrape, or interfere with the Service except where permitted by law.
• Circumvent usage limits, plan restrictions, unlock mechanisms, or security controls.
• Resell, sublicense, or provide unauthorized access to paid features without our permission.
• Use the Service in a way that degrades performance or harms other users.

We may investigate violations and take action including warnings, suspension, termination, or removal of access to models, plugins, or cloud features.

6. Your projects and local data

Your source code and project files generally remain on your device. You retain ownership of your projects and content. You are solely responsible for backing up your work, reviewing agent-generated changes before accepting them, and ensuring your use of the Service complies with your employer, client, or open-source obligations.

7. AI features and agent tools

AI outputs may be inaccurate, incomplete, insecure, or inappropriate for production use. You are responsible for reviewing, testing, and validating all suggestions, diffs, terminal commands, and generated code before relying on them.

• Do not submit secrets, credentials, personal data you are not authorized to share, or confidential information you cannot expose to model providers.
• Agent tools may read files, run terminal commands, or modify your workspace when enabled. Use confirmation settings and permissions carefully.
• Model availability, routing, latency, and quality may vary by plan, provider, and region.

Boongle does not guarantee that AI-generated output is original, non-infringing, or fit for any particular purpose.

8. Third-party services

The Service may integrate with or route requests to third parties, including authentication and database providers, model APIs, plugin publishers, Git hosts, Discord, payment processors, and documentation services. Your use of those services may be subject to their separate terms and policies. We are not responsible for third-party services we do not control.

9. Plugins and marketplace content

Plugins and marketplace items may be published by Boongle or third parties. Plugins run with the permissions you grant them. We do not warrant third-party plugins and may remove catalog entries that violate policy or create risk.

10. Intellectual property

Boongle IDE, its branding, website, documentation, and underlying software are owned by Boongle and its licensors and are protected by intellectual property laws. These Terms do not grant you ownership of the Service. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app for your internal development purposes.

Feedback, suggestions, or ideas you submit may be used by us without restriction or compensation.

11. Beta, early access, and downloads

Early releases, beta builds, and unlock codes may be limited, revoked, or changed at any time. Beta software may contain bugs and data loss risks. You use pre-release software at your own risk and should keep backups of important work.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOONGLE AND ITS TEAM, PARTNERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnity

You agree to defend, indemnify, and hold harmless Boongle and its team from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continued provision of the Service becomes impractical. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnity.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes may also be announced in the app, on the website, or by email where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms.

17. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

18. General

• These Terms are the entire agreement between you and Boongle regarding the Service.
• If any provision is unenforceable, the remaining provisions remain in effect.
• Our failure to enforce a provision is not a waiver of our right to do so later.
• You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or reorganization.
